BP LITIGATION UP-DATE: September 7, 2010

To: All Powell Law Firm clients regarding BP Chemical Exposure

Medical Testing: For those of you who have not already had the tests done, please contact the Gulf Coast Cancer & Diagnostic Center at (713) 474-1414 as soon as possible. They will make the appointments for you, and have agreed to conduct the tests on a "Letter of Protection" basis, meaning you pay for them from money we recover in the lawsuits, if and when we settle with the BP Defendants. ...Just tell them that your attorneys are with the Powell Law Firm.

Medical Insurance: If you have medical insurance, please send us a note immediately to 2405 South Grand Blvd., Pearland, Texas indicating the name of your insurance company, its location, and telephone number. And, for the Gulf Coast Cancer & Diagnostic Center or any other health care provider, be sure to let them know you have medical insurance.

Lawsuits against BP: As I previously indicated, we have filed the first lawsuit. In the next day or so we will be filing a larger one (Lawsuit No. 2) containing between 500 and 600 people. It will be filed in a state District Court of Galveston County. As soon as it is filed, you will be able to read the petition for yourself on the www.powellfirm.com web site. Be sure to check to see if your name appears on Exhibit "A" to the Petition. Call us at (281) 485-4252 if you have signed a contract with us and do not see your name. ...More and More people are calling every day, so if your name does not appear as a plaintiff in Lawsuit number 2, we will include you in Lawsuit No. 3. Remember, we must have a signed contract before we can represent you. And parents (or other persons with legal authority) must sign contracts for their/the children. Note: Grandparents cannot sign for their grandchildren unless a Court has awarded them conservatorship of their grandchildren.

Please understand that it is extremely difficult to talk to each of you personally. However, we need to know which of you are having the most serious problems. If you have been hospitalized and your physicians have connected your health problems to chemical exposure, please call us immediately. And for those of you who have not actually been hospitalized but are experiencing very serious things like bleeding, seizures, or just cannot breathe... Call now (281) 485-4252.

NOTE: The BP Defendants can be expected to put up a real fight in this litigation and will try to drag it out for years so don't expect any resolution of the lawsuits any time soon.

BP LITIGATION Update: August 19, 2010:

Our initial lawsuit against BP has been filed. Each Defendant must respond to the lawsuit within 20 days after it has been served with a copy of the Original Petition. That should be about the 15th of September.

By now all of you whom are our clients should have received my letter asking that you have your physicians conduct particular blood and urine tests. We must have the written test results in order to have our toxicologists and medical doctors evaluate your individual cases to determine if chemical exposure ...more likely than not... caused your symptoms/injuries.

NOTE: If you have already seen a physician, or been hospitalized for injuries resulting from chemical exposure, including problems with your pregnancy after April 6th, 2010, please get in touch with us.

Some of you have asked why we just filed suit on behalf of 10 people. ...The primary reason was to get the BP Defendants' attention and perhaps settle some of your claims without your having to go to the trouble and expense of having the tests done. Another reason is that, as a part of this litigation, BP's lawyers will ask the Court to dismiss those in the lawsuit who claim injury but (at the present time) have no proof that their symptoms or injuries were caused by exposure to BP's chemicals.

We are still trying to arrange for the blood and urine tests to be done upon letters of credit. In the mean time, for those of you who can afford them, I encourage each of you to have the tests done as soon as possible.

BP LITIGATION Update: August 11, 2010:


We have filed our initial lawsuit against the BP defendants relating to BP's release of toxic chemicals between April 6th and May 16th of 2010 at the Texas City, Texas plant.

If your name does not presently appear on the petition, do not be concerned unless you have not sent us your signed contract. In order to represent you, your spouse, or your children, we must have your signed contracts in our office. Parents must sign on behalf of their children.

In order to process your claims right away, you must provide us with the following medical test results:

  1. A complete blood count (cbc)
  2. Complete metabolic panel of the blood (cmp)
  3. Reticulocyte count of the blood
  4. A urinalysis


If you do not have a physician who will agree to conduct these tests - or cannot afford the expense of having them done right now- don't give up. We are making arrangements for the tests to be done based upon letters of protection. Meaning the tests will be done then paid for if and/or when cases are resolved through settlement or trial.

Those of you who can afford these tests should go ahead and ask your own physicians to conduct them. If you do not already have a physician who will agree to conduct these tests and provide you with the results, Dr. Kerry Laursen, telephone (713) 528-4440, may be able to work you into her schedule. Dr. Laursen charges $385.00 per person and is not presently accepting letters of credit in lieu of payment.
